CHARLOTTE -- The current North Carolina law prohibits the use of a cell phone by drivers under the age of 18. It is also illegal for drivers to text, play games and check email while driving.

The Charlotte Community Safety Committee is considering a city ordinance, with their own regulation.

In March, Chapel Hill's Town Council enacted an ordinance banning cell phone use all together. They're now facing a lawsuit involving a towing company, which said the ordinance greatly hurts their business.

Attorneys said Charlotte council members should take that into account.

"If we were to enact such an ordinance, I believe we would similarly face litigation costs and associated time and money defending it in court," said one Charlotte attorney.

Enforcement is the biggest issue Charlotte committee members see. Councilman Andy Dulin said to an extent that this should boil down to personal responsibility.

"Personal responsibility of us holding young drivers, middle aged drivers, and older drivers responsible for their conduct in a car," said Dulin.

Longtime Charlotte resident Jerry Mudge said something needs to be done, but that there isn't enough push to make it happen.

"People aren't upset. I had a personal meeting with Speaker Tillis two years ago and he said the reason nothing is being done is because people don't care. They need to start caring!" said Mudge.

Currently there are 10 states banning all cell phone use while driving.

For now, the Charlotte committee said they will watch the Chapel Hill case and continue to do their homework.
